BELLE — Daryl White, Jr.‘s trial date regarding Class A misdemeanor charges of stealing and official misconduct during his term as Belle mayor has been scheduled for 8:30 a.m. on Dec. 20, exactly a year after the investigation at City Hall took place.
White, his attorney Thomas J. Kirsch, and Missouri Attorney General’s Associate Attorney Gregory Goodwin were all present via Webex in Judge William E. Hickle’s Phelps County courtroom on Thursday when a trial date was set.
“At this point does it look like a case is going to go?” Hickle asked on Sept. 5 with all of the parties present.
Goodwin said they needed to set a trial date. He also informed the judge that a new disclosure regarding the case had been sent out that morning, which included seven pages that listed 41 separate case documents regarding White’s investigation. Among those listed were cases and press releases from the Vienna Police Department, Maries County Sheriff’s Office, Missouri State Highway Patrol letters and documentation, and 11 supplemental filings to name a few.
The previous disclosure discussion in court was on June 21 regarding an affidavit and invoice from Kimball Midwest, retailers of the case of black spray paint allegedly missing.
White is charged with two Class A misdemeanors — stealing and official misconduct — for a Sept. 26, 2023, incident. According to a probable cause statement from the Maries County Sheriff’s Office on Dec. 20, 2023, White allegedly “stole product from the City Road Department Garage” and is “believed to be misusing the city’s credit card again.”
White’s attorney filed for a speedy trial on Jan. 17, 2024, but both sides have asked for a continuance at various points.
Goodwin had expressed hope during the June 21 court date that an agreement would be made outside of court. However, Kirsch thought that the method of conclusion was unlikely.
“Is one day sufficient?” Hickle asked both parties on Thursday.
They agreed. The case is set for 8:30 a.m. on Dec. 20 in Hickle’s Phelps County 28th Circuit Court.
