Vienna releases records on officer firing, no investigation on file

BELLE — Records released by the city of Vienna in response to a Sunshine Law request show that the board of aldermen voted Aug. 25, 2025, to terminate Police Officer Kevin Green during a closed session, but provided no investigative or disciplinary records related to the decision.

The documents include the meeting agenda, approved open-session minutes and redacted closed-session minutes reflecting the motion and vote tied to Green’s termination.

According to those records, Mayor Tim Schell was present along with Aldermen Charles Davis, Reva Hutchison and Rita Juergens, as well as City Clerk Tracy Shiver.

The agenda for the special session included the tax rate discussion before entering closed session, followed by adjournment.

Meeting minutes indicate the board opened the meeting at 6 p.m. and adjourned into closed session at 6:01 p.m. under Sections 610.021.0, 610.021.9 and 610.021.13 of Missouri RSMo.

Under Missouri’s Sunshine Law, Section 610.021 allows public governmental bodies to close meetings under specific circumstances. Subsection .9 relates preparation, including any discussions or work product, on behalf of a public governmental body or its representatives for negotiations with employee groups. Subsection .13 allows closure of records and meetings involving individually identifiable personnel records. Section 610.021 generally provides the legal framework allowing such closed sessions.

Closed-session minutes show Juergens made a motion to terminate Green. Davis recused himself from the vote due to what the minutes describe as a personal relationship.

According to the minutes, Hutchison was initially unable to come to a decision, at which point the city clerk initiated a video call with Alderman Freddie Shiver so he could participate in the discussion.

Shiver then seconded the motion to terminate Green, which was approved with a 3-0-1 vote. Davis abstained.

The board exited closed session at 6:21 p.m. following a motion by Juergens, seconded by Hutchison.

While the city released documentation confirming the vote, officials said there were no responsive records related to investigative reports, disciplinary records or supporting documentation associated with Green’s termination.

The city also indicated that the termination letter dated Aug. 28, 2025, is closed under Section 610.021(13) of Missouri law, and that portions of the closed-session minutes are redacted under Section 610.021(3).

A lawsuit has since been filed in Maries County Circuit Court by Kevin Green challenging the termination. The petition alleges the city violated Missouri’s “Law Enforcement Officers Bill of Rights” by failing to provide a full due process hearing before or after the termination.

Court records show the case was filed Feb. 18 and a summons was issued requiring the city of Vienna to respond.

The case remains pending.
