VIENNA — A former Vienna police officer has filed suit against the city of Vienna, alleging he was terminated without being afforded the due process protections required under Missouri law.
Kevin Green filed a petition Feb. 18 in the 25th Circuit Court of Maries County, claiming the city violated the “Law Enforcement Officers Bill of Rights” when it terminated his employment without providing a full due process hearing under §590.502, RSMo.
According to the petition, Green was hired Aug. 12, 2025, as a police officer with the Vienna Police Department, where he served as a commissioned peace officer with the power to arrest for violations of the criminal code. The filing states he met the statutory definition of a “law enforcement officer” as defined in §590.502, RSMo.
The petition alleges Green’s employment was terminated during a special meeting of the Vienna Board of Aldermen on Aug. 25, 2025, and that the decision was later communicated to him in a letter dated Aug. 28, 2025. According to the filing, the city subsequently reported to the Missouri Peace Officer Standards and Training program on Sept. 10, 2025, that his employment had been terminated for “other reasons,” as stated in the court document.
Green contends he was not provided a full due process hearing either before or after his termination, which he alleges violates §590.502.3, RSMo. That section states that law enforcement officers who are suspended without pay, demoted, terminated, transferred or placed on a status resulting in economic loss are entitled to a full due process hearing under state law.
The petition also references §590.502.10, RSMo, which provides that a court shall void any action taken in violation of the statute and may award costs, including attorneys’ fees, if a violation is found.
Green asks the court to void the city’s action, reinstate him to his position as if he had never been terminated on Aug. 25, 2025, award him back pay and benefits accruing since that date, and require the city to pay his attorneys’ fees and other associated costs.
Green is represented by attorney Donald R. Weaver of Columbia. As of The Advocate’s Feb. 24 deadline no response had been filed by the city of Vienna in the case now pending before the Maries County Circuit Court.
