Vienna man faces felony charges of armed criminal action, kidnapping, exhibiting, assault

Several felony charges were filed Nov. 14 against Vienna resident Brian D. Wagner following a reported incident one week prior where he was accused of armed criminal action, kidnapping, exhibiting a weapon and assault.

According to the probable cause statement by Maries County Deputy John Durbin, the sheriff’s office was dispatched to Wagner’s Maries County Road 302 address for a report of a domestic dispute. Upon arrival, Durbin stated that the alleged victim informed him that she went to discuss some issues with Wagner when he accused her of sending screenshots of a personal conversation and things escalated.

She reported that Wagner physically and mentally abused her for several hours. MCSO stated she reported Wagner physically and mentally abused her — by choking her, shoving her into a wall and door frame several times and holding down on a bed. She also reportedly told the deputy that Wagner held a shotgun under his own chin and then under hers.

The alleged victim stated Wagner kept her from leaving for five hours before she convinced him she was leaving to go home and instead drove to the hospital where she was diagnosed with severe muscle pain and bruising.

Wagner faces the class D felonies of second degree domestic assault and second degree kidnapping, the unclassified felony armed criminal action and the class E felony of unlawful use of a weapon (exhibiting).

He was scheduled to appear Tuesday in front of Judge Kerry Rowden in the Associate Court of Maries County.
