Maries sheriff reports attempted stabbing, shooting, retrieves escapee

The Maries County Sheriff’s Department has been busy for the last two weeks with an attempted stabbing, attempted shooting, and retrieving an escapee.

A Highgate man was arrested after 2 a.m. on May 3 by the Maries County Sheriff’s Department following a 911 emergency call reporting an individual had been cut.

Maries County Sheriff’s deputies responded to the 911 call in the 25000 block of State Route U in Highgate early Tuesday morning and arrested Larry Bolton. Major Scott John said Deputy Jeff Younger responded first to the scene. 

“He was able to separate everybody and start gathering statements,” John said. “He also identified two victims that had been cut.”

In situations where a weapon is involved, the officer is required to call for backup. Several deputies responded to his request for assistance.

 “Larry Bolton was arrested,” John said. “Bolton was living in a residence on U Highway with three other subjects. He and another male subject of the residence don’t get along and Bolton claimed he was tired of being threatened. During an argument, he brandished a 10-inch hunting knife and sliced the left side of the victim’s head, face hand. They fought for the knife, which cut the victim’s hand pretty badly. Bolton received a cut on the wrist.”

The victim was transported to Phelps Health by Ozark Central Ambulance and transferred to Barnes Jewish Hospital. Bolton was arrested and taken into custody on a 24-hour hold. Charges on Tuesday afternoon at 3:50 p.m. allege armed criminal action, assault in the first degree, and unlawful use of a weapon.

Owensville couple arrested assault, firearm discharge

In another case, deputies responded to Maries County Road 315 on April 29 following a 911 emergency call for a domestic assault in progress.

“While our deputies were en route to the location, dispatch notified the deputy a firearm had been discharged,” John said. 

On scene, David A. Kelly, 32, of Owensville, was taken into custody, along with his wife Destiny Kelly. John said the incident began around 12:30 p.m. when the Kellys were still in their bedroom along with their infant daughter.

“The Kelly family was in a bedroom and the other residents of the house were talking in the kitchen,” John said. “Destiny came out and asked them to be quiet because. An argument broke out. One resident pulled a firearm on another resident of the house, a struggle ensued for the firearm and the firearm discharged, not striking anyone.”

Deputies Tyler Shepherd and Tim Edwards arrived on the scene. Upon arrival, when Shepherd tried to secure everyone, Destiny Kelly resisted and struck Shepherd in the mouth with her elbow when he was trying to detain her. Everyone was separated and they began taking statements on what occurred.

“David Kelly admitted to firing the firearm and brandishing the weapon during the argument,” John said. “The firearm was in the bedroom. We received permission to retrieve the firearm from the bedroom.”

While retrieving the firearm, deputies discovered multiple items of drug paraphernalia and marijuana in the bedroom. There was an indication of marijuana being actively smoked in the bedroom where a three-month-old child was present.

“David Kelly was arrested and charged for alleged armed criminal action, domestic assault in the first degree, unlawful use of a weapon, and endangering the welfare of a child,” John said. “Destiny Kelly was arrested for assault in the fourth degree, special victim, resisting arrest and endangering the welfare of a child. Both David and Destiny Kelly admitted to the marijuana and drug paraphernalia being theirs.”

Destiny Kelly was released after a 24-hour hold and was issued a court date. David posted a $25,000 bond or surety on May 3 with a May 24 court date.

Maries County escapee arrested, returned

In an April 26 event, a Bland man who escaped custody in Maries County last November was arrested in Gasconade County by the Missouri State Highway Patrol Troop F.

Terry Hodges, 34, of Bland, was arrested at 4:48 p.m.in Gasconade County on a Maries County felony warrant for escape from confinement.

“Terry Hodges appeared in court on Nov. 22, 2021,” John said. “The judge ordered a urine analysis that came back positive.” 

Once the court was notified, the department was ordered to hold him.

“The judge was going to revoke his bond, and he fled out the door,” John said. “The judge issued a warrant. Hodges was recently arrested and brought in on April 26. He was transported to Maries County Jail on April 27.”

Hodges appeared before Judge William Hickle on May 2 on both the escaped confinement charge as well as the original drug paraphernalia charge.

“He was released on his own recognizance and is due back in court on June 6 for the escape confinement charge for a counselor hearing,” John said. “He is due back again on July 8 for the original drug paraphernalia charge.”
