BELLE — A man from Bland faces three felony charges and one misdemeanor charge after the Belle Police Department arrested him for an incident allegedly instigated when he sent inappropriate messages to a 16-year-old.
Scott G. Birmingham, is charged with class D felony first-degree endangering the welfare of a child creating substantial risk - first offense - sexual conduct, class E felony resisting/interfering with arrest for a felony, class E felony assault - third-degree and misdemeanor sexual misconduct - second degree. BPD arrested him on a no-bond warrant from the Maries County Prosecuting Attorney’s Office.
According to a probable cause statement, the mother of the teenager reported on March 2 that a man in his 50s had been messaging her daughter on Facebook. The mother had been texting him pretending to be her daughter. Birmingham allegedly “texted her pictures of himself and was asking inappropriate questions.” The document alleges he also wanted to “hang out” and offered to bring alcoholic drinks.
BPD investigated and requested assistance from county law enforcement.
Birmingham allegedly arrived at the residence after receiving a message to come over, and he entered with alcoholic drinks. Law enforcement arrived shortly after. Birmingham allegedly struck one of the people at the residence and attempted to flee, but he was taken into custody.
Birmingham had an initial appearance in court on Tuesday. He has a counsel status hearing scheduled for 10 a.m. on April 1 in Maries County court.
